I. GENERAL INFORMATION

UAB “Simeksa” (hereinafter referred to as the Data Controller) hereby establishes the personal data processing conditions through these Privacy Policy (hereinafter referred to as PP) when using the website managed by the Data Controller. The terms set out in the PP apply every time you wish to access our content and/or service, regardless of the device (computer, mobile phone, tablet, TV, etc.) you use.

II. DATA CONTROLLER

A Data Controller is a natural or legal person, public authority, agency, or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.

III. SUPERVISORY AUTHORITIES

Committee for the Development of the Information Society under the Ministry of Transport and Communications and the State Data Protection Inspectorate. Data about the Data Controller is collected and stored at the Vilnius branch of the State Enterprise Centre of Registers.

It is very important that you read the PP carefully, because each time you visit the website or social media accounts belonging to the Data Controller, you agree to the terms described in these PP. If you do not agree to these terms, please do not visit our website/social media accounts or use our content and/or services.

We confirm that the data of visitors to the Data Controller’s websites and social media accounts will be collected in compliance with the requirements of applicable European Union and Republic of Lithuania legal acts and the instructions of controlling authorities. All reasonable technical and administrative measures are applied to protect the data we collect about website and social media account visitors from loss, unauthorized use, and alteration. The Data Controller’s employees are contractually obliged not to disclose or distribute information obtained at work to third parties, including information about website visitors.

Individuals under the age of 14 cannot provide any personal data for marketing activities through our website(s) and social media accounts. If you are under 14 years of age, you must obtain the consent of your parents or other legal guardians before submitting personal information for marketing purposes.

The terms used in these Rules are understood as defined in the General Data Protection Regulation No. 2016/679 (EU).

IV. WHAT INFORMATION DO WE COLLECT ABOUT YOUAND HOW DO WE USE YOUR INFORMATION?

Registration is not required for the Buyer to order goods in the online Store, but for proper order fulfillment, personal data such as name, surname, email, delivery address, phone number, and other data specified in the order must be provided.

 By placing an order for goods, the Buyer confirms that they agree to provide their personal data specified in these Rules, the registration form, and the goods order form, and does not object to the Seller processing this data for the purposes specified in these Rules.

The Buyer confirms that they are aware of their right to refuse to provide their personal data, but understands that personal data is necessary and essential for the fulfillment of the goods order, and if the Buyer does not provide such data and does not agree, the goods purchase and sale Agreement cannot be concluded and executed.

  •       companies that provide services at our request, e.g., companies engaged in postal and courier activities, the company whose server stores personal data, etc. The ability of these companies to use your information is limited; they cannot use this information for purposes other than providing services to us;
  •       other parties when required by law or necessary to protect our information society services.

Cases when we may disclose your information to other parties:

  •       to comply with laws or respond to mandatory court process requirements (e.g., upon receiving a legal search warrant or other court order);
  •       to confirm the legality of our actions;
  •       to protect the Data Controller;
  •       we may disclose your information to an affiliated third party in the event of a company merger, transfer, or bankruptcy;
  •       in other cases with your consent or at your lawful request.

VI. WHAT DO WE DO TO PROTECT YOUR INFORMATION?

We have implemented reasonable and appropriate physical, organizational, and technical measures to protect the information we collect for content/service provision purposes. However, please remember that although we take appropriate steps to protect your information, no website, online transaction, computer system, or wireless connection is completely secure.

VII. YOUR RIGHTS

The data subject whose data is processed in the Data Controller’s activities has the following rights:

  •       to know (be informed) about the processing of their data (right to know)
  •       to access their data and how it is processed (right of access)
  •       to request rectification or, taking into account the purposes of personal data processing, to supplement incomplete personal data (right to rectification)
  •       to have their data erased or to stop processing their data (except for storage) (right to erasure and right to be forgotten)
  •       to request that the Data Controller restrict the processing of personal data if one of the legitimate reasons exists (right to restriction)
  •       the right to data portability (right to portability)
  •       the right to object to the processing of their personal data or to withdraw their consent to the processing of personal data at any time, for personal data to be processed for one or more specific purposes, without affecting the lawfulness of processing based on consent before its withdrawal.

The Data Controller may not provide data subjects with conditions to exercise the above-mentioned rights when, in cases provided by law, it is necessary to ensure the prevention, investigation, and detection of crimes, official or professional ethics violations, as well as the protection of the rights and freedoms of the data subject or other persons.

VIII. THIRD-PARTY WEBSITES, SERVICES, AND PRODUCTS ON OUR WEBSITES

The Data Controller’s website or social media accounts may contain third-party banners, links to their websites and services, which the Data Controller does not control. The Data Controller is not responsible for the security and privacy of information collected by third parties. You must be careful and read the privacy provisions applicable to the third-party websites and services you use.

IX. COOKIES, BEACONS, AND SIMILAR TECHNOLOGIES

In these PP, we use the term “cookies” to describe cookies and other similar technologies, such as pixel tags, web beacons, and clear GIFs.

XII. FINAL PROVISIONS

These PP are reviewed at least once every two years. Upon updating the PP, we will inform you about what we consider to be significant changes by publishing a notice on the specific website or social media accounts. If you log in or use our content and/or services after such a notice is published, we will consider that you agree to the new requirements specified in the update.
