The manufacturer&#8217;s warranty obligations are valid only if the product operating conditions specified in the warranty certificate and the product user manual have not been violated. To avoid misunderstandings, we strongly urge you to carefully read the product operating instructions, warranty obligations, and free service conditions.  <\/p>\n\n\n\n<p>When submitting a product for warranty repair, you must provide the product purchase document and the product warranty certificate. During the warranty period, warranty repair is performed free of charge. Note: from September 9, 2010, the product purchase document (VAT invoice) also serves as the warranty certificate.    <\/p>\n\n\n\n<p>If, after purchasing one of these products, you notice that it is of poor quality, you have the right to return such a product to us within the period specified in the product warranty certificate. In such cases, the defective product will be replaced free of charge with a quality product, or the money paid will be refunded to you. <\/p>\n\n\n\n<p>Quality electrical and heating appliances may be returned only within the period specified in legal acts and our Purchase and Sale Terms, and only in compliance with the requirements specified in Section 11 of the Terms. In this case, you pay the product return costs. <\/p>\n\n\n\n<p>\u00a7&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;the manufacturer&#8217;s warranty does not apply to naturally wearing product parts.<\/p>\n\n\n\n<p>&nbsp;Deliver products for warranty service to UAB &#8220;SIMEKSA&#8221; warranty service points, except for the exceptions specified in the sections below.<\/p>\n\n\n\n<p>During warranty service, defects arising due to the manufacturer&#8217;s fault are remedied within the following periods: 14-21 days from the transfer of the product to the service performing warranty service, or within 45 days if a part necessary for warranty repair must be delivered from abroad. In all cases, warranty service is performed as quickly as possible. <\/p>\n\n\n\n<p>The quality warranty provided by the seller does not limit or restrict consumer rights established by legal acts upon acquiring a product or service of inadequate quality.<\/p>\n\n\n\n<p>When delivering a product to the warranty center, you must provide all documents supplied by the manufacturer with the product, and the product purchase document (this invoice), which also serves as the product warranty certificate.<\/p>\n\n\n\n<p>The product must be delivered in such a configuration that it can be turned on.<\/p>\n\n\n\n<p><strong>Please note that:<\/strong><\/p>\n\n\n\n<p>\u00a7&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;all costs associated with transporting the product to and from the warranty center are paid by the Buyer;<\/p>\n\n\n\n<p>\u00a7&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;warranty conditions for repaired or replaced products apply for the remaining warranty period;<\/p>\n\n\n\n<p>If, after purchasing one of these products, you notice that it is of poor quality, you have the right to return such a product to us within the period specified in the product warranty certificate. Money is refunded to the buyer only when the product has reached the seller and its commercial appearance is intact.  <\/p>\n\n\n\n<p>\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2013<\/p>\n\n\n\n<p><strong>RULES FOR RETURN AND EXCHANGE OF GOODS<\/strong><\/p>\n\n\n\n<p><strong>ORDER OF THE MINISTER OF ECONOMY OF THE REPUBLIC OF LITHUANIA<\/strong><strong><br\/>O R D E R<\/strong><\/p>\n\n\n\n<p><strong>ON THE APPROVAL OF RULES FOR RETURN AND EXCHANGE OF GOODS<\/strong><\/p>\n\n\n\n<p><strong>June 29, 2001 No. 217<\/strong><strong><br\/>Vilnius<\/strong><\/p>\n\n\n\n<p><br>Implementing Article 6.362, Part 4 of the Civil Code of the Republic of Lithuania (Official Gazette, 2000, No. 74-2262) and executing point 3.2.3 of the Resolution No. 1506 of the Government of the Republic of Lithuania of December 27, 2000 &#8220;On the Approval of the Implementation Plan for the Civil Code of the Republic of Lithuania&#8221; (Official Gazette, 2000, No. 113-3631):  <\/p>\n\n\n\n<p>1. I approve the Rules for Return and Exchange of Goods (attached).<\/p>\n\n\n\n<p>2. This order enters into force on July 1, 2001. <\/p>\n\n\n\n<p>Acting Minister of Economy Eugenijus Gentvilas  <\/p>\n\n\n\n<p>______________<\/p>\n\n\n\n<p><strong>APPROVED<\/strong><strong><br\/>by Order No. 217 of the Minister of Economy<br\/>of the Republic of Lithuania of June 29, 2001<\/strong><\/p>\n\n\n\n<p><strong>RULES FOR RETURN AND EXCHANGE OF GOODS<\/strong><\/p>\n\n\n\n<p><strong>I. GENERAL PROVISIONS<\/strong><\/p>\n\n\n\n<p><br>1. These rules establish general requirements for the procedure for returning and exchanging goods (hereinafter referred to as products) sold to buyers, excluding medicines, water, electricity, fuel, and other products supplied through utility networks.<\/p>\n\n\n\n<p>2. These rules must be observed by sellers (including natural persons who have acquired trading licenses) selling products to buyers.<\/p>\n\n\n\n<p>3. The basic terms used in these rules correspond to the terms used in the first, second, third, and fourth sections of Chapter XXIII of Part IV of Book Six of the Civil Code of the Republic of Lithuania (Official Gazette, 2000, No. 74-2262) (hereinafter referred to as the Civil Code).<\/p>\n\n\n\n<p><br>II. SPECIFICS OF RETURN AND EXCHANGE OF NON-FOOD PRODUCTS <\/p>\n\n\n\n<p><br>4. If a non-food product of inadequate quality was sold to the buyer and the seller did not discuss its defects with the buyer, the buyer has the right to demand from the seller, at their choice:<\/p>\n\n\n\n<p>4.1. to replace the product of inadequate quality with a product of adequate quality;<\/p>\n\n\n\n<p>4.2. to reduce the product price accordingly;<\/p>\n\n\n\n<p>4.3. to remedy the product defects free of charge within a reasonable period;<\/p>\n\n\n\n<p>4.4. to reimburse the costs of remedying product defects if, after the seller failed to remedy them within a reasonable period, the defects were remedied by the consumer themselves or with the help of third parties;<\/p>\n\n\n\n<p>4.5. to unilaterally terminate the purchase and sale agreement and demand a refund of the money paid for the product.<\/p>\n\n\n\n<p>5. The product quality warranty is established by the product seller.<\/p>\n\n\n\n<p>6. Products are exchanged or returned at the place of product purchase or at another location specified by the seller that is convenient for the buyer. The buyer submits a written request to the seller, indicating the product defects and one of the requirements from Section 4 of these rules selected by the buyer. A cash register receipt or purchase-sale receipt, or another document confirming the purchase-sale of the product from this seller, and a warranty document (if a quality warranty period has been established for the sold product) must be attached to the request.  <\/p>\n\n\n\n<p>7. If the buyer does not provide a cash register receipt or another document issued in the prescribed manner confirming the purchase-sale of the product from this seller, the product is exchanged or other requirements specified by the buyer in Section 4 of these rules are fulfilled only with the seller&#8217;s consent.<\/p>\n\n\n\n<p>8. In the event of disagreements between the buyer and the seller regarding product quality, the seller, upon receiving a written request from the buyer, must contact the State Non-Food Products Inspectorate under the Ministry of Economy (hereinafter referred to as the State Non-Food Products Inspectorate) in writing within no later than 3 working days regarding product quality assessment, and upon receiving written conclusions from it, immediately notify the buyer.<\/p>\n\n\n\n<p>9. If the seller does not fulfill the requirements specified in Sections 4 or 8 of these rules, the buyer may contact the State Non-Food Products Inspectorate regarding product quality assessment, and upon receiving written conclusions from it, notify the seller.<\/p>\n\n\n\n<p>10. Product quality assessment costs are paid in the manner established by legal acts.<\/p>\n\n\n\n<p>11. The seller and\/or buyer, if they wish, may participate in the product quality assessment.<\/p>\n\n\n\n<p>12. Large and heavy (weighing more than 10 kg) non-food products of inadequate quality are transported by the seller for quality assessment, exchange, repair, or return, unless otherwise specified in the purchase and sale agreement. The quality of such products may also be assessed at the buyer&#8217;s home. <\/p>\n\n\n\n<p>13. If the seller proves that product defects arose because the buyer violated the product use or storage rules, such a product is not exchanged, defects are not remedied free of charge, and money is not refunded.<\/p>\n\n\n\n<p>14. If the buyer is dissatisfied with the shape, size, color, model, or completeness of the purchased product, they have the right to exchange it for a similar product within fourteen days from the date of sale of the non-food product, unless the seller has established a longer period.<\/p>\n\n\n\n<p>If the seller does not have a suitable product for exchange, the buyer has the right to return the product to the seller within the period specified in the first paragraph of this section and recover the money paid for it.<\/p>\n\n\n\n<p>15. Products specified in Section 14 of these rules are exchanged or returned at the place of product purchase or at another location specified by the seller that is convenient for the buyer. The buyer submits a written request to the seller, indicating their wish. A cash register receipt or purchase-sale receipt, or another document confirming the purchase-sale of the product from this seller, must be attached to the request.  <\/p>\n\n\n\n<p>16. The buyer may exercise the right established in Section 14 of these rules if the product has not been used, it is not damaged, and has not lost its commercial appearance. Changes to the appearance of the product or its packaging that were necessary to inspect the product cannot be considered significant changes to the product&#8217;s appearance. <\/p>\n\n\n\n<p>17. In the event of a dispute regarding changes to the product&#8217;s appearance or product damage, the seller must contact the State Non-Food Products Inspectorate in writing, and upon receiving written conclusions from it, immediately notify the buyer.<\/p>\n\n\n\n<p>18. The buyer&#8217;s requirement to exchange the purchased product for similar products or to refund the money paid for the reasons specified in Section 14 of these rules is not satisfied upon acquiring the following products:<\/p>\n\n\n\n<p>perfumery, cosmetics, and toilet preparations (codes according to the Combined Nomenclature of Goods -33.03-33.07), photography and cinematography products (code according to the Combined Nomenclature of Goods \u2013 37.00), printed books, reproductions, and other printing industry products (code according to the Combined Nomenclature of Goods \u2013 49.00), fabrics (codes according to the Combined Nomenclature of Goods \u2013 50.07, 51.11-51.13, 52.08-52.12, 53.09, 55.12-55.16), carpet floor coverings, excluding carpets and rugs (code according to the Combined Nomenclature of Goods \u2013 57.00), knitted men&#8217;s, boys&#8217;, women&#8217;s, or girls&#8217; underwear (codes according to the Combined Nomenclature of Goods \u2013 61.07 \u2013 61.09), babies&#8217; garments (code according to the Combined Nomenclature of Goods \u2013 61.11), stockings, socks, half-socks, and other similar products (code according to the Combined Nomenclature of Goods \u2013 61.15), sewn men&#8217;s, boys&#8217;, women&#8217;s, or girls&#8217; undershirts, nightshirts, pajamas, and similar products (codes according to the Combined Nomenclature of Goods \u2013 62.07 \u2013 62.08), babies&#8217; garments (code according to the Combined Nomenclature of Goods \u2013 62.09), brassieres, girdles, corsets, and similar products (code according to the Combined Nomenclature of Goods \u2013 62.12), pearls, precious stones, precious metals and their products, excluding imitation jewelry (code according to the Combined Nomenclature of Goods \u2013 71.00, excluding 71.17), machinery and mechanical appliances (code according to the Combined Nomenclature of Goods \u2013 84.00), electrical machinery and equipment, sound recording and reproduction apparatus, and television image and sound recording and reproduction apparatus (code according to the Combined Nomenclature of Goods \u2013 85.00), land transport vehicles (code according to the Combined Nomenclature of Goods \u2013 87.00), ships, boats, and floating structures (code according to the Combined Nomenclature of Goods \u2013 89.00), optical, photographic, cinematographic, measuring, checking, medical, or surgical instruments and apparatus (code according to the Combined Nomenclature of Goods \u2013 90.00), clocks and watches (code according to the Combined Nomenclature of Goods \u2013 91.00), musical instruments (code according to the Combined Nomenclature of Goods \u2013 92.00), arms and ammunition (code according to the Combined Nomenclature of Goods \u2013 93.00), furniture, bedding, lamps (code according to the Combined Nomenclature of Goods \u2013 94.00), toys, games, excluding sports and fishing equipment (code according to the Combined Nomenclature of Goods \u2013 95.00, excluding 95.06 \u2013 95.07).<\/p>\n\n\n\n<p><br>IV. RIGHTS AND OBLIGATIONS OF THE BUYER AND SELLER <\/p>\n\n\n\n<p><br>26. The rights and obligations of the buyer and seller are regulated by the provisions of the first, second, third, and fourth sections of Chapter XXIII of Part IV of Book Six of the Civil Code.<br\/><br\/>V. SELLER&#8217;S LIABILITY<\/p>\n\n\n\n<p>27. The seller must familiarize employees with these rules and other legal acts regulating retail trade.<\/p>\n\n\n\n<p>28. Persons who violate the requirements of these rules are held liable in the manner established by law.<br><br>VI. CONTROL <br>&nbsp;<\/p>\n\n\n\n<p>29.
